We are not your typical landlord

We take the “lord” out of landlord and use the more modern term "owner". Our “Model Lease” is probably better than any other lease in Kentucky! We provide a “Tenant Bill of Rights” that is more modern and honorable. How do we do that? Most landlords run roughshod over the rights of tenants. They think they can enter the premises any time they want. They can enter any room or go into any drawer they want. They think they can keep the full deposit by blaming damages done by the tenant. They think they have the right to raise rent to any amount they want. Tenants are often treated like second class citizens. We don’t think that is right or fair. Since 1975, I have been an advocate of tenant's rights helping to pass legislation in many cities from New Jersey to California working with Governors, Mayors, councilmember and over 100 tenant organizations. Louisville's tenant's rights are stuck in the 19th century with few modern protections. Tenants deserve a lot more than that so we have incorporated many of the modern tenants rights into our leases like those in California, New York or New Jersey. So even if you don't rent from us, know your legal rights. We offer a Tenant Bill of Rights that most landlords would never consider or offer:

  • Rent control- When you sign a lease, we tell you how much the rent would be if you renew. If rent is paid on time and problem free, we give current tenants first right of renewing their lease.

  • Right to privacy- We give you at least 48 hour notice via email or phone call when we need to enter your premises for a reasonable purpose.

  • No more creepy workers going in the wrong places!- We prefer for you to be present for any repairs so you don’t have to worry whether the plumber or anyone else is going into places they shouldn't be.

  • References- Hey landlords will ask you for references, why not ask them for a few. We will provide you with names of tenants who have rented from us now and in the past. Keeping deposits is not part of our business plan. We have a record of fairness, but to get your deposit you'll have to clean up and return the house to how it was, which is an A+ cleaning job. At a minimum, we expect the refridgerator, oven, toilets and tub to be cleaned.

  • Fairness in returning most if not all of the cleaning deposits!- Most landlords are trained to trick you into keeping most if not all of your cleaning or security deposit. One seminar in Louisville has taught 500 landlords how to get “thirteen months of rent out of twelve.” We want to give you back your cleaning and security deposit. We will even have our house cleaner coach you on what you need to do and we pay him to do that! It's called "fairness to tenants", so they don't fear being ripped off and it maintains our good reputation.

  • Right to a safe neighborhood and house- All of our homes are located in the Highlands which is ranked as having one of the lowest crime rates in Louisville. To our knowledge, since 1998 we are not aware of any crimes in any of our rentals. Even if you don’t rent from us, ask the landlord if they have any knowledge of crimes occurring in their rentals. They must tell you of any crimes that have occured in their units, such as rape, murder, theft, etc.

  • 100% Smoke free environments- We ban smoking in all of our buildings and on grounds. Cleaning up the damage caused by smoking can cause anywhere from $500 to $1000 to ameliorate.

  • Making repairs sooner rather than later- All houses need regular repairs, maintenance, and updating. Too many landlords take their time and feel its more profitable to delay making repairs. When something needs repair, you contact us and we refer to our eager maintenance guy to get it done quickly. It is our belief that it is better to fix it quickly so that tenants will want to continue renewing leases from us. Moreover, things that go unrepaired might make things worse, like a leaky faucet.

  • Progressive lease that protects tenants rights- Our lease was designed in collaboration with tenant advocates to give you maximum protections.

  • Free application- Far too many landlords ask for “application fee” that is designed to discourage certain classes of people. Our applications are free of charge. Too often corporate landlords keep the fee and don't give you the place you want in the first place. It's called bait and switch.

  • Pet friendly- We are ok with house trained pet or cat— but you must clean up any mess. Our insurance representative says no dangerous or large dogs. Maybe you could start with a goldfish!

  • House as a symbol of self- Ok, you can’t take out a wall but we will give you permission to paint a room another color if we like your choice of colors. No more white walls! We love pastels which our interior decorator has chosen.

  • Freedom of expression- Most landlords won’t allow you to put political signs on your front lawn before elections, we encourage it.

  • Breaking your lease- We have provisions that will allow you to break your lease for an administration fee that is much less than what most landlords might charge. But you keep paying rent until it is rented out.

  • Conflict aversion- We don’t like conflict and our goal is to be conflict free. We honor the lease and expect you to do the same. We offer a progressive lease with these rights weaved in- that means lack of conflict. We have an amazing record of only 4 small claims cases, all of which were ruled in our favor. We do background checks to protect us and fellow tenants.

  • Deposits to hold a unit- If you truly fall in love with one of our places and “gotta have it” you can give us a non-refundable deposit to hold it. If we say yes, it goes to the cleaning and security deposit and if we say no we return it immediately.

  • Acting green- Just living in the Highlands is a green act since it’s the most walkable neighborhood with much shorter commutes to downtown, Univervisity of Louisville and Bellarmine. We encourage energy conservation by using fans. Energy saving lights, removing false ceilings, using transoms and changing roof shingles from black to white have been part of our efforts in conservation. We also use passive solar heating by installing sky lights as well as heat releasing ducts designed by the University of Kentucky and the University of Louisville. Because of our green practices, one of our units has an average gas and electric bill of about $29 per month. We like it when tenants show their green colors by locking their bikes outside, recycling, and walking to Bardstown Road restaurants, stores, and pubs. Did you know you can save $8,000 a year by giving up a car? Highlands is probably the best neighborhood for going car free.

  • Appliances- Beware landlords who will show you a house with appliances that will be removed when you sign the lease. When you sign a lease with us, we'll let you know exactly what appliances you'll be getting.

  • Safety- All of our units have smoke detectors, but we're in the process of voluntarily installing carbon monoxide detectors and plan to do so by Summer of 2013.

  • Professionalism- Every year about 10,000 landlords are fined roughly 3 million dollars for things ranging from littered beer bottles to faulty plumbing. We have never been fined because we provide prompt and professional service. It's good business and it leads to a higher number of renewals.
